Is it legal to place a claim on an auto insurance policy that was bought by one person & owned by another?

A mother bought an insurance policy on her sons (who is the registered owner) truck, claiming to be the registered owner when she is not, I do not believe that the son was even listed as an additional driver. The son got into a car accident totaling the truck. When the insurance company asked for the title in the mothers name, they went to the bank, paid off the debt on the truck, transferred the title, then provided the title to the insurance company with the mothers name on it. The insurance company was Geico. They then collected on the total loss, PIP & medical coverages, is this legal or fraudulent?

  1. It is not fraudulent. It is not illegal. Neither party gained unjust enrichment. They just did not set up the policy correctly. It may be the agent's fault.
