An innocent person is involved in a freak auto accident?

The driver of a commercial company was driving a truck and not paying any attention because he was too busy "talking on a cell telephone, while driving". He jetted across the lines of traffic, on an expressway, causing the top of an industrial cooler top to come flying out of the back of his truck flying like a frisbee doing about 90 mph hitting another auto, who as a result of, the driver of the vehicle hit obtained a "CLOSED BRAIN INJURY" due to his actions. The person injured has not been able to work for 5 years and lost their business of 14 years, which was very success, a home that had to be sold after19 years as well as other items they had obtained in their 45 years of life, to be able to pay for medications and everyday life as well as all of other things. They also obtained other medical issues as a result of same. What compensation should the injured party be compensated on a million dollar insurance policy for all the hell they have been through already and all she will have to go through the rest of her life since the injury is permanent?

  2. Usually, the injured party would recover any medical bills they paid as a direct result of the accident. Plus any loss of income or in this case, the loss of the ability to do their job, from their current age to age 65. So the formula is like this: Annual Income x (65- current age) + Medical bills = Injury compensation amount. If this is more than the company has in insurance, the injured party will have to sue the company directly to recover the remaining amount.
