In California, the law states that a landlord has 21 days to get a deposit back to tenant. Can someone clarify?

I would like to know if this means they can mail it on day 21 and still meet the requirement or if it has to be in the hands of the tenant on day 21. Thanks. According to the Department of Consumer Affairs: Under California law, 21 calendar days or less after you move, your landlord must either: Send you a full refund of your security deposit, or Mail or personally deliver to you an itemized statement that lists the amounts of any deductions from your security deposit and the reasons for the deductions, together with a refund of any amounts not deducted Thank you. Yes, I understand they don't have to return the deposit if they have a reason to keep it. In my case, they have no reason to keep it.

  1. I'd say mailed within 21 days.
  2. "send" would indicate put it in the mail. It does not require the deposit to be returned though, they can mail you a letter telling you they will not be returning it.
  3. nlt; on the 21st day, your refund must be postmarked. Why not do it on the 3rd day, and stop kiting?
