Is it acceptable to pass on mailing lists?

work in a hotel, is it ok to pass on the mailing list to the next owners with out the guests permission?? feels wrong!! Thank You, i thought it was, just needed it clarifying

  1. It is wrong, and is also illegal. This data was given to you and you alone, so is legally protected under the Data Protection Act. Do not pass them on! Only if you mail each person in turn and ask them if they want their details passed on to the new owners is it legal.
  2. If you are in the UK then it is wrong, and a breach of the Data Protection Act - unless you get the express prior consent of all of the people whose details you are passing on.

  6. Hate to muddy the water, but are the new owners buying the business name? It's an offence to pass the mailing list to another business, but it is part of the hotels assets as a business. If the only thing changing is ownership they own the list, it comes under goodwill which they have paid for. They are buying the existing clientele. If however they plan to change the hotel into something else like a health club for instance, then no they aren't entitled without the consent of those named. In that case the current management would need to write to each individual for consent, before handing their details over.
