Do I have to apply for a fictitious business name in CA for a home daycare?

I already have an internet business that I run from home on top of my full-time job which I already have a fictitious name for. I plan to quit my day job and start a daycare in my home. Do I still need to apply and file for a fictitious business name if I am only offering services and not selling anything? Also where do I check to see if the name is available? I had someone else do the work for me the last time so I don't know.

  1. If you are doing business in Ca legally then yes. You will have to go to your county recorders office (or call) they can tell you if the name is availible in your county. You will be "selling" your time and abilities. You must also be licensed thru the state of Ca for childcare. They are really craking down on illeagl daycares right now because of the Ca budget deficit and are administering hefty fines on more people doing illeagal business in Ca each day to help close the deficit gap. They are also increasing the licenseing requirements and fees associated with it. Good Luck!
  2. you can always find out if your desired name is taken at this website: http://www.lavote.net/CLERK/FBN_Search.cfm As far as your other questions go, yes, if you are providing a service or selling any product, to be recognized as a real business, you MUST file a DBA and publish it in a newspaper within the first 30 days of your filing at the County Recorders Office.
