Moronic Mechanic, Do I have a Case?

7 Months ago, I had Payed a Man to fix My car. He is a back yard mechanic who owns many businesses. The Head gaskets had cracked in my vehicle and he said he would put in a new engine a few weeks later he says his vehicle to haul it was broken down, so he didn't have the engine. we had given him until my graduation in Late May to fix it, which was well over two months,. When that date comes around he says he hasn't even started because he couldn't get the engine because his friend was "sick". We are angry but being that he is a nice guy we tell him get it done ASAP. He finally gets our engine, which didn't fit because it wasn't the right one. so he says he is goign to rebuild our old one and repair it. and Mind you this was in july...... So anyways he cashes our check before telling us this and doesn't pick up his phone for weeks and then tells us that he was waiting for a check to get the heads for the engine. Which we never agreed to pay him for being that he already had the money for the New engine we never got. So we demand that he finish it quickly, around august I am getting completely fed up, and I tell him that he has two weeks or im taking him to court. So he says "i will have it done by next week. Next week comes around and he never called. we finally got a hold of him and he said "my son got in a accident and we don't know if he is goign to make it. SO right then and there I feel bad so I tell him get it done when you can. So I went online to the Small town "under 2,000 people" and look for news of the accident...there is none..and this is the kinda town that reports littering on he front page. So He lied. I'm pissed. I could of built a house in 7th months by my self (not a big one but still). in the amount of time that took. He has cost me jobs because I couldn't get to job interviews being i have no CAR. He has cost 7 months of car insurance payments for nothing and he has cost me time and money on top of that. Does anyone think I have a case for civil court, and if so what should I sue for, I have never brought anyone to court before so I am clueless on the matter. I agree with the first post. We went cheap, and got the raw end of the deal. We did write the check specifically for a new engine it even says so on the check.. We do have many mechanics in the family that say it was more sensible to get a new engine. but due to geographical issues we couldn't pay one of them to do the job.

1. You caused this yourself. If you take him to court, he will ask to see the contract he signed. You DO have a contract, right? Of course you don't. You tried to get a job done cheap and got bit. Any real mechanic would not try to replace an engine when the gaskets are cracked. Even if the head was cracked.
