Are there any laws or restrictions on marketing firearms through direct mail?
I am interested in sending out a direct mail piece advertising my store that sells firearms. Are there any restrictions to the artwork or to the demographics of the mailing list that I choose to send out?

- Yes, many state laws consider advertising to be an "offer" to sell, and thus regulated within their states. You may have to place statutory disclaimers or limitations in the ads to avoid prosecution for "attempted sale" within a reguated state, assuming they permit such ads at all. You may also have to specifically state the requirement that customers deal with a local dealer having a Federal Firearms License, who is the only one (in the USA) allowed to receive firearms across state lines or through the mail. Again, states vary, and some don't consider the National Gun Control Act to have any bearing on how they run their affairs inside the state.
